SIPO Issues New Guides for Patent Examination

In accordance with the Implementing Regulations of the Patent Law of the People's Republic of China, State Intellectual Property Office draws up and issues the new version of the Guides for Patent Examination. It will take force on July 1, with the Examination Guides issued on October 18, 2001 as well as the Examination Guiding Bulletins issued hereafter abolished at the same time. The Guide sets forth exhaustively the new standards for patent examination and approval. It abolishes the patent cancellation procedure, broadens the judicial relieves for patent review and invalidation cases as well as the protective objects of utility model patent and the scope of preliminary examination.
